C&P Sues Warner Bros on Behalf of "Sorting Hat" Voice Actor Marc Silk

Yesterday, Clinton & Peed filed a complaint in federal court in California against Warner Bros on behalf of British voice actor Marc Silk and his company, The Production Pit Limited. The complaint alleges that (with the permission of Warner Bros and J.K. Rowling) Mr. Silk created recordings of certain performances in which he portrayed the talking “Sorting Hat” of the Harry Potter universe. Mr. Silk granted permission for these recordings to be used only in connection with a particular plush animatronic “Sorting Hat” toy.

C&P Files Amicus Brief Endorsing Speedy Trial Date for President Trump Jan. 6 Case

Earlier today, Clinton & Peed filed an amicus brief as local counsel for nearly a dozen former judges and senior legal officials in support of the government’s proposed trial date and schedule in the criminal case against Donald Trump pending in the U.S. District Court for the District of Columbia alleging criminal interference in the 2020 election. The brief opposes the attempt by former President Trump’s legal team to postpone the trial until after the election.

C&P Secures Verdict Worth $2.7 Million for Estate of South Carolina Lawyer

After a one-day jury trial in the Eastern District of Virginia before Judge Leonie Brinkema, Clinton & Peed has a secured a judgment worth up to $2.7 million for the estate of John (“Jack”) C. West, Jr., a South Carolina lawyer who represented the individuals taken and held hostage from the U.S. embassy in Tehran, Iran, during the period from November 1979 through January 1981.

C&P Secures Appellate Reversal from D.C. Court of Appeals in Commercial Lease Case

The D.C. Court of Appeals granted the appeal filed by Clinton & Peed, reversing the trial court’s decision dismissing its client’s claims on summary judgment. In its ruling for U Hall, the Court adopted the most tenant-favorable argument, announcing new law that should help future commercial tenants facing similar problems. Specifically, the “court[] adopt[ed] a more liberal view, as U Hall ask[ed] [it] to do, invoking equitable principles to enforce options whose prices are to be fixed at a later date.” Under this view, “when a lease contains an option provision that leaves the rental price for the option year(s) to be agreed upon at a later date, a court can infer that the parties would have agreed on a reasonable rental price for each option term.”

C&P Secures Dismissal of All Charges Against Former State Department Foreign Service Officer

In a landmark ruling for the District of Columbia, District Judge Trevor McFadden has thrown out all charges against C&P client Paul Guertin, a decorated former Foreign Service Officer. The indictment alleged that Mr. Guertin withheld information on his Standard Form-86 (“SF-86”) during his periodic security clearance review process as part of his State Department employment. The government pursued an unusual and aggressive legal strategy, charging Mr. Guertin with wire fraud (18 U.S.C. § 1343) on the theory that he fraudulently obtained his ongoing salary through the alleged omissions. The government also charged him with obstructing an official proceeding—his security clearance review—under 18 U.S.C. § 1512(c).

C&P Representing Black Lives Matter Protester Wrongfully Arrested by D.C. Police

A recent story in DC-area news source WTOP quotes partner Greg Lipper in connection with a story about 41 individuals arrested in Adams Morgan for charges ranging from felony rioting to assaulting a police officer. The D.C. Superior Court appointed Mr. Lipper to represent the only person among those 41 protesters that the government elected to press charges against. That individual has been charged with misdemeanor assaulting a police officer.

Greg Lipper Quoted in Vox.com on Monday's Supreme Court Decision on Funding of Religious Schools

Our partner Greg Lipper is quoted in Vox.com’s explainer on Monday’s Supreme Court decision in a major church-state-separation case, Espinoza v. Montana Department of Revenue. In the 5–4 decision, the Court held that under the First Amendment’s Free Exercise Clause, Montana may not exclude religious entities from a tax-credit program that funds scholarships to private secondary schools. Greg, who filed an amicus brief on behalf of several major disability-rights organizations, explained how the decision will inevitably lead to more discrimination against and segregation of children with disabilities.

C&P Asks D.C. Circuit to Apply DC's Anti-SLAPP Law in Federal Court

Earlier this week Clinton & Peed filed a brief urging the U.S. Court of Appeals for the D.C. Circuit to rule that the District’s Anti-SLAPP Act—a law that protects people and organizations against abusive SLAPP suits designed to harass public advocates and censor public advocacy—applies to cases brought in federal court. The amicus brief, filed in Tah v. Global Witness Publishing, Inc., was filed on behalf of eleven prominent public-interest advocacy organizations.
