Yesterday, Clinton & Peed filed a complaint in federal court in California against Warner Bros on behalf of British voice actor Marc Silk and his company, The Production Pit Limited. The complaint alleges that (with the permission of Warner Bros and J.K. Rowling) Mr. Silk created recordings of certain performances in which he portrayed the talking “Sorting Hat” of the Harry Potter universe. Mr. Silk granted permission for these recordings to be used only in connection with a particular plush animatronic “Sorting Hat” toy.

In its ruling for U Hall, the Court adopted the most tenant-favorable argument, announcing new law that should help future commercial tenants facing similar problems. Specifically, the “court[] adopt[ed] a more liberal view, as U Hall ask[ed] [it] to do, invoking equitable principles to enforce options whose prices are to be fixed at a later date.” Under this view, “when a lease contains an option provision that leaves the rental price for the option year(s) to be agreed upon at a later date, a court can infer that the parties would have agreed on a reasonable rental price for each option term.”

The indictment alleged that Mr. Guertin withheld information on his Standard Form-86 (“SF-86”) during his periodic security clearance review process as part of his State Department employment. The government pursued an unusual and aggressive legal strategy, charging Mr. Guertin with wire fraud (18 U.S.C. § 1343) on the theory that he fraudulently obtained his ongoing salary through the alleged omissions. The government also charged him with obstructing an official proceeding—his security clearance review—under 18 U.S.C. § 1512(c).
