C&P Files Supreme Court Cert Petition Challenging Alabama Probation Orders Issued Without Judicial Review or Approval

Today Clinton & Peed has filed a petition for a writ of certiorari, asking the U.S. Supreme Court to reinstate our clients’ legal challenges to coercive probation orders, issued in Montgomery, Alabama without judicial review or approval. The U.S. Court of Appeals for the Eleventh Circuit held that our clients’ lawsuits were barred by the RookerFeldman doctrine, a judge-made jurisdictional rule barring federal courts from hearing lawsuits challenging state-court judgments.

Clinton Brook & Peed Files Appellate Brief Challenging Appointment of Acting Attorney General Matthew Whitaker

Earlier this month we filed an amicus brief, in the U.S. Court of Appeals for the Third Circuit, supporting a challenge to President Trump’s authority to appoint Matthew Whitaker as Acting Attorney General. We submitted the brief on behalf of Morton Rosenberg, who became one of the nation’s leading authorities on the Federal Vacancies Reform Act while serving at the Congressional Research Service when the statute was drafted and enacted.

Clinton Brook & Peed Files Brief in Supreme Court Criminal-Restitution Case

Today we filed a brief in the U.S. Supreme Court in Lagos v. United States, No. 16–1519, an important criminal case in which the Court is considering whether the federal Mandatory Victims Restitution Act (MVRA) authorizes restitution for companies' internal investigations that were neither requested nor required by the government. We prepared the amicus brief on behalf of Shon Hopwood, a professor at Georgetown Law and a promiment advocate for criminal-justice reform. Before becoming a lawyer, Professor Hopwood served nearly eleven years in federal prison after pleading guilty to multiple bank robberies; his path from prisoner to lawyer was recently profiled on 60 Minutes.

ESPN Covers Latest Developments in Consumer-Fraud Lawsuit Against NY Giants, Eli Manning

ESPN reports on the latest developments in our consumer-fraud lawsuit, on behalf of memorabilia collectors, against the New York Giants and QB Eli Manning. We allege, and the evidence reflects, that (1) Eli Manning, with the help of other Giants' personnel, provided counterfeit “game-used” items to Steiner Sports, which sold them to collectors, including our clients; and (2) the Giants learned about these practices and failed to stop them, much less remedy them. The fraudulent memorabilia includes a helmet displayed in the Pro Football Hall of Fame as purportedly worn by Eli Manning during the Giants’ Super Bowl 42 win against the New England Patriots.

Clinton Brook & Peed Settles Wrongful-Death Lawsuit Against U.S. Army

In 2014, we filed a Federal Tort Claims Act lawsuit against the United States government, seeking to redress the wrongful deaths of 19-year-old Michael Roark and 17-year-old Tiffany York due to negligence by the U.S. Army. Last week, we finalized a settlement of the case on behalf of their parents. Our clients will receive a total of $4 million from the government.
